发现乘客失物及时归还或上交,这是出租车司机应有的职业道德.然而,安徽芜湖市一名的哥在归还乘客遗失的手机前,竟索要500元报酬,理由是“乘客手机贵”.乘客无奈给钱要回手机,心寒之余举报了他.涉事出租车公司要求驾驶员吕师傅当面向乘客赔礼道歉,退还索取的500元钱,停车3天接受培训.（5月7日《江淮晨报》）
当强索的感谢费成为手机失而复得的前提条件,必然会导致感恩之心的萎缩,也会在无形之中切割消费者与商家的信任存量.
从法理上看,《物权法》第112条规定“权利人领取遗失物时,应当向拾得人或者有关部门支付保管遗失物等支出的必要费用”；从情理上讲,出租车司机在归还乘客遗失物的时候,需要付出一定的劳动,期间还会影响正常的营运.因此,“拾金求报”作为的哥的一种利益表达,并不违法；然而,索取酬金的具体数额确实值得商榷,的哥“坐地起价”不可避免地遭受公众的质疑和批评.
按照当事人吕师傅的说法,平时捡到乘客的东西很多,身份证之类的经常有,自己都是主动交到出租车公司的.这一次,索要500元酬劳完全是“看人下菜”,按照乘客遗失苹果手机市场价格的10%收取 ,“并不算多”.显而易见,吕师傅错误地理解了报酬请求权,违背了失主奖励拾金不昧者的自愿性原则.
偏差的利益表达,让 “拾金求报”的双方都成为受伤者；乘客有了不愉快的消费经历,的哥“赔了夫人又折兵”.消除争议和纠纷的关键,在于建立新的互动规则.只有通过明文规定的法律制度规范失物归还酬金的标准问题,明晰施报双方权利与义务的边界,类似的尴尬才会逐渐减少.
这些年来,在社会大变革、大转型中,原来和谐的社会关系出现了迷乱,社会公德水平不是提高了,反而是下降了.个人主义膨胀,拜金主义横行,道德准则的失灵,政府应该承担相当大的责任,政府对整个社会应该提倡什么,怎样引导民众树立正确的价值观有清醒的认识,这不是简单地立个法就完事,立法还应该要考虑到对整个社会道德观和价值观的冲击,以及带来的负面结果.
