當強索的感謝費成為手機失而復得的前提條件,必然會導致感恩之心的萎縮,也會在無形之中切割消費者與商家的信任存量.
從法理上看,《物權法》第112條規定「權利人領取遺失物時,應當向拾得人或者有關部門支付保管遺失物等支出的必要費用」；從情理上講,計程車司機在歸還乘客遺失物的時候,需要付出一定的勞動,期間還會影響正常的營運.因此,「拾金求報」作為的哥的一種利益表達,並不違法；然而,索取酬金的具體數額確實值得商榷,的哥「坐地起價」不可避免地遭受公眾的質疑和批評.
按照當事人呂師傅的說法,平時撿到乘客的東西很多,身份證之類的經常有,自己都是主動交到計程車公司的.這一次,索要500元酬勞完全是「看人下菜」,按照乘客遺失蘋果手機市場價格的10%收取 ,「並不算多」.顯而易見,呂師傅錯誤地理解了報酬請求權,違背了失主獎勵拾金不昧者的自願性原則.
偏差的利益表達,讓 「拾金求報」的雙方都成為受傷者；乘客有了不愉快的消費經歷,的哥「賠了夫人又折兵」.消除爭議和糾紛的關鍵,在於建立新的互動規則.只有通過明文規定的法律制度規范失物歸還酬金的標准問題,明晰施報雙方權利與義務的邊界,類似的尷尬才會逐漸減少.
